Black Tie Day Promo Competition Terms and Conditions

The promoter of the Black Tie Day Promo Competition (“the Competition”) is We Buy Cars Ltd (“WeBuyCars”), with registration number 2015/130772/07, a company incorporated in the Republic of South Africa and having its registered address at Building 7, Byls Bridge Boulevard, Highveld, Centurion.
All persons entering this Competition (“Participants”) agree to the Competition Terms and Conditions (“these T&Cs”) as set out herein below.
Please read these T&Cs carefully, as some of these T&Cs may limit the risk or liability of WeBuyCars or a third party and/or may create a risk or liability for the Participant and/or may compel the Participant to indemnify WeBuyCars or a third party and/or serve as an acknowledgement of the Participant, of a fact.
None of the content of these T&Cs is intended to or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created either for WeBuyCars or the Participant in terms of the Consumer Protection Act 68 of 2008 (“the Act”) and the Regulations of the Act.
By entering the Competition, the Participant acknowledges that he/she has had an opportunity to read these T&Cs and that the Participant understands and agrees to these T&Cs.
The Competition will be overseen by an independent third party.
All Participants must be older than 18 (eighteen) years. The Participant must have a South African ID document or valid passport and relevant documents allowing them to purchase and sell a vehicle and/or motorbike and/or trailer and/or caravan and/or boat (“Unit”) in South Africa.
No employee, director, member, partner, agent or consultant or any person directly or indirectly who controls, or is controlled by, WeBuyCars and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by WeBuyCars or its agencies, advisers, dealers, suppliers, its affiliates and/or associated companies may enter the Competition.
All auction sales and Units bought by dealers and wholesalers will not be eligible for “Roll-The-Dice” discounts.
By buying a Unit and qualifying for the Competition, the Participant(s) authorise WeByCars to collect, store and use (but not to share) the personal information of the Participants for the reasons set out in WeBuyCars’ privacy policy, which is available at www.webuycars.co.za/privacy. The Participants are entitled to decline any communication for marketing purposes.
The “Roll-The-Dice” discounts will only apply to Participants purchasing Units via cash or finance.
Participants must purchase a Unit in cash or finance from Friday, the 29^th of November 2024, to Saturday, the 30^th of November 2024 on the aforementioned dates.
Participants can participate in “Roll-The-Dice” to obtain random discounts applicable to the selling price of the Units purchased in cash or after the Offer to Purchase has been signed for finance transactions during the Competition period from Friday, the 29^th of November 2024, to Saturday, the 30^th of November 2024.
The discount offered through “Roll-The-Dice” is limited to the purchase price of the Unit on the invoice. In the event that the Unit is bought for less than the discount won, the discount will be limited to the full purchase price of the Unit on the invoice. No excess discount beyond the purchase price will be applied or redeemable in cash or otherwise.
The discount obtained through the “Roll-The-Dice” is non-transferable and cannot be assigned, sold, or transferred to any other party, individual, or transaction. Additionally, there shall be no variation, modification, or alteration of the discount T&Cs, as determined by WeBuyCars, and these T&Cs shall remain binding on the Participant involved in the specific invoiced transaction.
In the event of a transaction cancellation, including cancellations under sections 55 and 56 of the Act, any discount obtained through “Roll-The-Dice” will be forfeited by the Participant. Consequently, the Participant shall have no entitlement, in cash or any other form, to the discounted amount. Additionally, the forfeited discount will not be transferable or applicable to any replacement Unit or subsequent purchase.
The winners will be final, and no communication will be considered in this regard.
The winners will be publicly announced through social media platforms, which will include posts containing personal information about the winners. This information may encompass, but is not limited to, photographs, videos and the names of the winners (“personal information”). By entering the Competition, winners provide their consent for the publication of the aforesaid personal information. Winners may withdraw consent for the publication of their personal information by sending an email to [email protected]. However, such withdrawal will not apply to materials already published or distributed before the withdrawal of consent was received.
The prizes will be immediately handed over to the winners.
The winners undertake to, as fast as possible, do all things necessary to enable the promoter to comply with its obligations in terms of the Act, including, but not limited to, providing such personal information as may be required to facilitate the handing over of the prize.
WeBuyCars may refuse to award the prize(s) to any Participant(s) if there is any suspicion of irregularity or fraud.
By entering the Competition all the Participants and the winners indemnify WeBuyCars, including its associated companies, their directors, officers, employees and agents, against any claims for any loss or damages, whether direct, indirect, special, incidental or consequential or otherwise, arising from any cause whatsoever connected to or arising from their participation in any way in this Competition.
These T&Cs may be amended by notification at any time during the Competition.
WeBuyCars may cancel the Competition at its own reasonable discretion.

The competition and the subsequent prize draw will be subject to the oversight of an independent third party.
All Participants must be older than 18 (eighteen) years. The Participant must have a South African identity document or a valid passport. The Participant must have all of the required documents allowing them to sell a motor vehicle as defined in the National Road Traffic Act of 1996 (“Vehicle” or “Vehicles”) in South Africa.
No employee, director, member, partner, agent or consultant or any person directly or indirectly who controls, or is controlled by, WeBuyCars or its holding company and/ or any subsidiary of WeBuyCars (“the Group”), and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Group or its agencies, advisers, dealers, suppliers, its affiliates and/or associated companies may enter the Competition.
Entries resulting from the sale of a Vehicle by a dealer or wholesaler to WeBuyCars will not be eligible for the Competition.
By selling a Vehicle and qualifying for the Competition, the Participant(s) authorise WeBuyCars to collect, store and use (but not to share) the personal information of the Participants for the reasons set out in WeBuyCars’ privacy policy, which is available at https://www.webuycars.co.za/privacy. The Participants are entitled to decline any communication for marketing purposes.
A Participant receives 1 (one) automatic entry into the Competition draw for every Vehicle successfully sold to WeBuyCars during the competition dates as set out in Clause 15.
The Competition draw is based purely on an entry into a draw for a single prize, being a credit of R200 000 (Two Hundred Thousand Rand), redeemable only against the purchase price of any Vehicle(s) offered for sale by WeBuyCars (“the Prize”). This credit cannot be transferred, assigned, sold, or redeemed for cash in part or in full.
The Prize must be used within 6 (six) months of the winner being notified. Any unused portion of the credit after this period will be automatically forfeited.
If the purchase price of the Vehicle(s) bought by the winner is less than R200 000 (Two Hundred Thousand Rand), the remaining credit will be forfeited. No change or cash equivalent will be paid out.
Participants must successfully sell and transfer ownership of a Vehicle to WeBuyCars from 24 November 2025 to 1 December 2025 (“Competition Dates”) to qualify for entry into the Competition draw. The sale must be fully concluded and the funds must have been successfully transferred to the Participant on or before the end of the Competition Dates.
The winner will be selected via a random draw from all eligible entries received during the Competition Dates. The draw will take place on or before 2 December 2025 by an independent third party.
The winner of the draw will be final and no correspondence or disputes will be considered in this regard.

The winner will be notified via the contact details provided to WeBuyCars during the vehicle sale transaction.
The winner undertakes to, as fast as possible, do all things necessary to enable WeBuyCars to comply with its obligations in terms of the Act, including, but not limited to, providing such personal information as may be required to facilitate the granting of the Prize.
WeBuyCars may refuse to award the Prize to any Participant if there is any suspicion of irregularity, crime or fraud.
By entering the Competition, all the Participants and the winner indemnify WeBuyCars, including its associated companies, their directors, officers, employees and agents, against any claims for any loss or damages, whether direct, indirect, special, incidental or consequential or otherwise, arising from any cause whatsoever connected to or arising from their participation in any way in this Competition.
This Competition is subject to change. WeBuyCars reserves the right to amend these T&Cs, or to suspend or cancel the Competition at any time without prior notice or liability.
